We combine prior research on ethical decision-making in organizations with a rational choice theory of corporate crime from criminology to develop a model of corporate offending that is tested with a sample of U.S. managers. Despite demands for increased sanctioning of corporate offenders, we find that the threat of legal action does not directly affect the likelihood of misconduct. Managers’ evaluations of the ethics of the act, measured using a multidimensional ethics scale, have a significant effect, as do outcome expectancies (...) that result from being associated with the misconduct but not facing formal sanctions. The threat of formalsanctions appears to operate indirectly, influencing ethical evaluations and outcome expectancies. Background With growth of genomics research in Africa, concern has arisen about comprehension and adequacy of informed consent given the highly technical terms used in this field. We therefore decided to study whether there are linguistic and cultural concepts used to communicate heritability of characters, traits and diseases in an indigenous African population. Methods We conducted Focus Group Discussions among 115 participants stratified by sex, age and socio-economic status and Key Informant Interviews among 25 stakeholders and Key Opinion Leaders among (...) Yoruba living in Ibadan, Nigeria. We used Atlas-ti v.8.3.17 software to analyze the data, using thematic approach. Results The study participants identified several linguistic and cultural concepts including words, proverbs, and aphorisms that are used to describe heritable characters, traits and diseases in their local dialect. These included words that can be appropriated to describe dominant and recessive traits, variations in penetrance and dilution of strength of heritable characteristics by time and inter-marriage. They also suggested that these traits are transmitted by “blood”, and specific partner’s blood may be stronger than the other regardless of sex. Conclusions Indigenous Yoruba populations have words and linguistic concepts that describe the heritability of characters, traits and diseases which can be appropriated to improve comprehension and adequacy of informed consent in genomics research. Our methods are openly available and can be used by genomic researchers in other African communities. (shrink)

With this issue we initiate the policy of expanding the scope of Tulane Studies in Philosophy to include, in addition to the work of members of the department, contributions from philosophers who have earned advanced degrees from Tulane and who are now teaching in other colleges and universities. The Editor THE LOGIC OF OUR LANGUAGE ROBERT L. ARRINGTON Wittgenstein wrote in the Tractatus that "logic is not a body of doctrine, but a mirror-image of the world. " 1 In line (...) with his suggestion that a proposition is a 'picture', Wittgenstein argued that propositions 'show' the logical structure of the real. He was insistent, however, that "the apparent logical form of a proposition need not be its real one. " 2 As a result of this we can misunderstand the structure of fact. Philosophical problems arise just when "the logic of our language is mis understood. " 3 It is common knowledge that much of this view of logic was rejected by Wittgenstein himself in the Philosophical Investi gations. There we are told that language has no ideal or sublime 4 logic which mirrors the structure of the extra-linguistic world. Consequently, inferences from the structure of language to the structure of that extra-linguistic world are invalid. Reality can be 'cut up' in any of a number of ways by language. Wittgenstein adopted a view of philosophy which would render that discipline a non-explanatory, non-critical study of the multiple ways in which language can be used. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Hume Studies Volume 28, Number 1, April 2002, pp. 113-130 Bayesianism, Analogy, and Hume's Dialogues concerning Natural Religion SALLY FERGUSON Introduction Analyses of the argument from design in Hume's Dialogues concerning Natural Religion have generally treated that argument as an example of reasoning by analogy.1 In this paper I examine whether it is in accord with Hume's thinking about the argument to subsume the version of it given (...) in the Dialogues under the model of probabilistic reasoning offered by Bayes's theorem. Wesley Salmon attempted this project in 1978.2 In related projects, David Owen3 as well as Philip Dawid and Donald Gillies4 have more recently attempted to construct Bayesian analyses of Hume's argument concerning testimony in "Of Miracles." I want to be careful at this stage to note exactly what I will claim. It is not that Bayesian reasoning sheds no light on the argument from design, or on arguments concerning testimony. All of the analyses mentioned above are beneficial in that they have been able to expose subtleties in these arguments that had previously gone unnoticed. Salmon's paper, in particular, contributes nicely to an understanding of just how the design argument may function in relation to contemporary scientific reasoning. In this paper I argue that, nonetheless, the attempt to apply Bayesian reasoning to the argument as presented in the Dialogues is not well supported as a reconstruction of Hume's own approach to the argument from design. I begin by considering how much Hume knew of Bayes's theorem, and what consequence that knowledge might have had on his treatment of the argument in the Dialogues. This discussion includes a consideration of exactly what has been claimed by other authors on this subject, including what some have argued concerning Hume's reasonings in "Of Miracles," section 10 of An Enquiry concerning Human Understanding. I conclude that, based on the historical data, there is little reason to think of Hume's approach to the argument from design as anything more than proto-Bayesian at best. I then argue further, through a close textual analysis of the Dialogues, that there are good reasons for not treating Hume's reasoning there as even proto-Bayesian. In the end, the benefits that have been claimed for that approach, in terms of exposing both the subtleties of the argument and of Hume's reasoning about it, can equally well be derived from a careful analysis of the argument under a model of analogical reasoning, without need of Bayes's theorem. Section One Perhaps one might think that there is not much use for a consideration of the question whether Hume himself conceived of any of his arguments along specifically Bayesian lines. As Gower argues,5 Hume's knowledge of mathematics in general was fairly limited, and Bayes's theorem was not well known even up until Hume's death. It is important, therefore, for me to establish that there have not only been those who thought that Bayesian reasoning illuminates the arguments Hume gave, but also his own thinking about those arguments. It is also important for me to establish that it is not obvious that knowledge of Bayes's theorem did not affect Hume's reasonings. Each of these points will be addressed in the following. As to the first point, the claims of some authors on the subject are ambiguous. Dawid and Gillie, for example, make no statement to the effect that the probabilities involved in Bayes's theorem were in fact examined in "Of Miracles," nor do they attempt to produce any passages from Hume in support of that view. Thus it would be assumed that they see their attempt not as an attempt to provide an analysis that represents Hume's own approach to the argument, but rather simply as one that provides an illuminating method of analysis and support for an argument that Hume happened to give. We examined developmental changes in British children’s (8- to 10-year-olds) and adolescents’ (13- to 15-year-olds,N = 340; FemaleN = 171, 50.3%) indirect bystander reactions (i.e., judgments about whether to get help and from whom when witnessing social exclusion) and their social-moral reasoning regarding their reactions to social exclusion. We also explored, for the first time, how the group membership of the excluder and victim affect participants’ reactions. Participants read a hypothetical scenario in which they witnessed a peer being excluded from (...) a school club by another peer. We manipulated the group membership of the victim (either British or an immigrant) and the group membership of the excluder (either British or an immigrant). Participants’ likelihood of indirect bystander reactions decreased from childhood into adolescence. Children were more likely to get help from a teacher or an adult than getting help from a friend, whereas adolescents were more likely to get help from a friend than getting help from a teacher or an adult. For both indirect bystander reactions, children justified their likelihood of responding by referring to their trust in their teachers and friends. Adolescents were more likely to refer to group loyalty and dynamics, and psychological reasons. The findings support and extend the Social Reasoning Developmental (SRD) approach by showing the importance of group processes with age in shaping children’s judgments about how to respond indirectly by asking for help from others, when they are bystanders in a situation that involves exclusion. The findings have practical implications for combating social exclusion and promoting prosocial bystander behavior in schools. (shrink)

Why has it taken so long for member states to appoint women to the Court of Justice? Despite having won relatively significant policy instruments for equal treatment at work and high levels of legislative representation, women in the European Union have been slow to extend the demand for gender mainstreaming to courts. Prior to 1999, the Court of Justice had had one woman member until Ireland appointed Fidelma Macken in late 1999, and Germany appointed Ninon Colneric and Austria appointed Christine (...) Stix-Hackl Advocate General in 2000.The 1995 U.N. meeting in Beijing was a catalyst for the demand for balanced participation of women and men in decision-making processes within the E.U., and it coincided with Sweden, Finland and Austria joining and championing the cause of gender equality. In 1999, the Commission published a report on women in the judiciary and women lawyers began to organize across Europe. After tracing the appointment process, I review the European Parliament's role in championing women on the Court and consider recent developments. Courts, particularly supranational and federal courts, are representative institutions even if their representative function differs from legislatures. Non-merit factors have always been a factor in judicial appointments and thus the demand for women on the bench is not a terrible deviation from merit. An all male bench is no longer legitimate. In a pair of very important papers, namely “Space, Time and Individuals” in the Journal of Philosophy for October 1955 and “The Indestructibility and Immutability of Substances” in Philosophical Studies for April 1956, Professor N. L. Wilson began something which badly needed beginning, namely the construction of a logically rigorous “substance-language” in which we talk about enduring and changing individuals as we do in common speech, as opposed to the “space-time” language favoured by very many mathematical logicians, perhaps most notably (...) by Quine. This enterprise of Wilson's is one with which I could hardly sympathize more heartily than I do; and one wishes for this logically rigorous “substance-language” not only when one is reading Quine but also when one is reading many other people. How fantastic it is, for instance, that Kotarbinski1 should call his metaphysics “Reism” when the very last kind of entity it has room for is things —instead of them it just has the world-lines or life-histories of things; “fourdimensional worms”, as Wilson says. Wilson, moreover, has at least one point of superiority to another rebel against space-time talk, P. F. Strawson; namely he does seriously attempt to meet formalism with formalism—to show that logical rigour is not a monopoly of the other side. At another point, however, Strawson seems to me to see further than Wilson; he is aware that substance-talk cannot be carried on without tenses, whereas Wilson tries to do without them. Wilson, in short, has indeed brought us out of Egypt; but as yet has us still wandering about the Sinai Peninsula; the Promised Land is a little further on than he has taken us. (shrink)

This is another volume in the continuing series published under the auspices of Tulane University. It contains eight articles. Ramona Cormier’s article "The Concept of Isolation in Contemporary Aesthetic Theory" uses the term isolation in accordance with Langer’s definition. In order to develop her point Cormier distinguishes between the historicity of an art work and the historiography of the work. On the basis of this she discusses briefly the attitudes of Jerome Schiller, Clive Bell, T. S. Eliot, Jerome Stolnitz, Roger (...) Fry, George Dickie. Shannon DuBose remarks in "Poesis and Cosmos" that "... views advanced [on art] in The Republic loom larger than need be in discussion of Plato’s theory of art; they should be balanced with suggestions advanced in other dialogues, particularly The Timaeus." One cannot agree more with this need for balance. Professor Feibleman’s article "The Art of the Philosophy of Art" is not so much a discussion of the philosophy of art as it is a discussion of the artist, the role of art in society, the relation of art to other areas of a culture in which art specifically exists. John Glenn, Jr. has written on "Kierkegaard on the Unity of Comedy and Tragedy." I do not agree with all his interpretations of Kierkegaard but his article is interesting. Harold N. Lee in "Action, Perception and Art" rethinks a position he held in the original edition of his Perception and Aesthetic Value. He now holds that "... the two views of the nature of art can be shown to be essentially related and not only externally so...." Marian L. Paulson writes an article, "Structures in Art Media," where she suggests that perhaps the problem of structural relations among art media may find a solution if one takes account of the Jungian notion of the racial unconscious, especially in the resolution of the tensions between anima and animus and between the shadow and transcendence. The article "Truth in Art" by Louise N. Roberts discusses one of the many ways in which the expression "truth in art" may be considered. The author in this case shows how paintings may present a truth in a way quite different from verbal statements. Although the empirical studies of Terror Management Theory lend support to Ernest Becker's anthropology, they hardly provide a vision with the power to inspire late twentieth century humanity. Becker's own dark view of what it means to be human is, at least in part, to blame. On the basis of an exploration of the positive implications of the religious symbol of creatureliness, an alternative social theory, that of ecologico‐social democracy, is proposed as a vision that requires and may even inspire (...) heroism. One way of answering this question is to translate ‘God is omniscient’ into some slightly more formalised language than colloquial English, e.g. one with variables of a number of different types, including variables replaceable by statements, and quantifiers binding thes.

Interpreting heritability estimates through the lens of cultural evolution presents two broad and interlinking problems for educational behavior genetics. First, the problem of interpreting high heritability of educational phenotypes as indicators of the genetic basis of traits, when these findings also reflect cultural homogeneity. Second, the problem of extrapolating from genetic research findings in education to policy and practice recommendations.
